The website www.mystro.com.au (“Website”) and the Mystro platform and services (together, the “Platform”) are owned and operated by Fintek Pty Ltd (ABN 67 618 866 014) (“Fintek”, “Mystro”, “we”, “us”, or “our”).

By accessing or using our Website or Platform, you agree to be bound by these Terms of Service (“Terms”), including our Privacy Policy. If you do not agree, you must immediately cease using the Platform.

1. Services Provided

We provide SaaS products and related services, including but not limited to:

  1. Online form technology, enabling accurate data collection.
  2. Automated document collection workflows.
  3. eSignature functionality for secure digital signing of documents.
  4. Marketing, communications, and workflow automation tools.

We may update, enhance, or discontinue features of the Platform at our discretion.

2. Registration and Accounts

To use certain features of the Platform, you must register for an account. By registering, you:

  • provide accurate, current, and complete information (including personal and business details),
  • agree to keep your username and password secure,
  • accept responsibility for all activities under your account.

You must be:

  • at least 18 years of age,
  • legally capable of entering into a binding contract,
  • authorised to act on behalf of your business if registering in a business capacity.

We may suspend or terminate accounts where details are false, misleading, or incomplete.

3. Collection Notice and Privacy

We collect and process personal information to provide and improve our services, in line with our Privacy Policy. This may include disclosure to trusted third-party service providers such as Amazon Web Services (AWS), Twilio, Google, Microsoft, Equifax, and Meta, who may store or process data in Australia or overseas.

By providing personal information, you consent to its collection, use, and disclosure as described in our Privacy Policy.

4. Acceptable Use

You must not use the Platform in a way that is unlawful, abusive, or otherwise inappropriate, including (without limitation):

  • breaching privacy or other legal rights of individuals,
  • defaming or harassing any person,
  • uploading viruses, malware, or malicious code,
  • transmitting unauthorised or offensive material (e.g., defamatory, obscene, racist, or threatening),
  • interfering with security or network operations of the Platform or third parties.

We may remove content, suspend, or terminate accounts at our discretion for breach of these Terms.

5. Electronic Signatures

Where the Platform provides eSignature capability:

  • documents signed electronically have the same legal effect as physical signatures under the Electronic Transactions Act 1999 (Cth),
  • you are responsible for ensuring that eSignatures are acceptable in your specific use case (including with regulators, lenders, or courts),
  • Mystro is not liable for any failure of an electronically signed document to be recognised by third parties.

6. Linked Websites

Our Website and Platform may contain links to third-party websites. We do not control, endorse, or assume responsibility for third-party content, products, or services.

7. Intellectual Property

All intellectual property rights (including copyright, designs, patents, trademarks, and software) in the Platform and Website are owned by or licensed to us.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for your internal business purposes, in accordance with these Terms.

You must not copy, modify, distribute, sell, or otherwise exploit our content or software except as expressly permitted by law.

8. Warranties and Disclaimers

To the maximum extent permitted by law, including the Australian Consumer Law:

  • the Platform is provided “as is” and “as available”,
  • we do not warrant uninterrupted or error-free access,
  • we make no guarantee as to accuracy, timeliness, or reliability of content,
  • we are not responsible for viruses, malware, or harmful code that may affect your systems.

Where warranties cannot be excluded, our liability is limited to the re-supply of the relevant services.

9. Limitation of Liability

To the fullest extent permitted by law, we are not liable for:

  • any indirect, incidental, special, or consequential loss,
  • loss of profits, data, goodwill, or business interruption,
  • damages arising from unauthorised access to your account or data.

Our total liability for all claims in connection with the Platform will not exceed the fees paid by you for the 12 months preceding the event giving rise to liability.

10. Indemnity

You indemnify and hold harmless Fintek, its directors, officers, employees, and agents from any claims, damages, losses, or costs arising from your:

  • breach of these Terms,
  • misuse of the Platform,
  • infringement of intellectual property or third-party rights.

11. Service Availability and Suspension

We strive to maintain reliable and secure services but do not guarantee uninterrupted availability.
We may suspend, restrict, or terminate access to the Platform without liability where:

  • maintenance, upgrades, or technical issues require it,
  • you breach these Terms,
  • we reasonably believe your use threatens the security or operation of the Platform.

12. Changes to Terms

We may amend these Terms from time to time by publishing an updated version on our Website. Continued use of the Platform constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of NSW.
